Terms of Use
These terms are the agreement between you and Numero, operated by Derek Gay, for using the Numero app and website. By creating an account or using the app, you agree to them. Please also read the Privacy Policy, which explains how your data is handled.
What Numero is, and is not
Numero produces nutrition estimates. When you photograph a meal or describe it, the app uses AI models and food databases (brand data, USDA entries and similar sources) to guess what is on the plate, how much of it there is, and what that adds up to. Those numbers are estimates for informational purposes only.
Numero is not medical advice. It is not a medical device and it is not a substitute for a physician, registered dietitian or any other qualified health professional. Do not rely on Numero to manage a medical condition, diabetes, a food allergy, an eating disorder, pregnancy, breastfeeding, or any diet prescribed by a professional. If you have a health concern, or before making significant changes to how you eat, consult a professional.
Calorie and nutrient estimates can be wrong, sometimes by a lot. Portions are hard to judge from a photo, ingredients can be hidden, and database entries can be out of date. You are responsible for checking anything that matters to you.
Your account
You must be at least 13 years old to use Numero. You are responsible for keeping your sign-in details private and for everything that happens under your account. Give us accurate information and keep it current. One person per account.
Subscriptions: Numero Pro
- Some features require a paid subscription, Numero Pro, offered monthly or annually.
- Subscriptions are purchased through Apple and billed to your Apple ID. Prices are shown in the app before you buy and may vary by region.
- Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Apple charges the renewal within 24 hours before the current period ends.
- You manage and cancel your subscription in your Apple ID settings (iOS Settings → your name → Subscriptions). Deleting the app does not cancel a subscription.
- Refunds are handled by Apple under App Store policy; we cannot issue them directly. Any free trial converts to a paid subscription unless cancelled before it ends.
- Apple’s Licensed Application End User License Agreement applies to your use of the app, in addition to these terms. Where the two conflict, these terms govern the relationship between you and Numero, and Apple’s EULA governs the relationship with Apple.
Acceptable use
Use Numero for tracking your own food and health. Do not:
- reverse-engineer, scrape, or interfere with the app or our servers, or access them by any means other than the app;
- upload content that is illegal, that you have no right to share, or that contains other people’s personal information;
- use Numero to build a competing dataset or service, or resell access to it;
- share an account, circumvent subscription checks, or use the service in a way that puts an unreasonable load on it.
Your content
You own the photos, voice notes and entries you put into Numero. You give us a licence to store and process them so we can run the service for you, as described in the Privacy Policy. If you explicitly report a meal as a bad read, you agree that we may look at that meal to improve the analysis.
Our content
The app, the website, the Numero name and logo, and everything we made are ours or our licensors’. These terms give you a personal, non-transferable licence to use the app on Apple devices you own or control, in line with Apple’s EULA. That is all.
Ending things
You can delete your account at any time in Settings → Account → Delete account. We may suspend or terminate your account if you break these terms, if we are required to by law, or if we discontinue the service; where practical we will give you notice. Sections that by their nature should survive (disclaimers, limitation of liability, governing law) do.
Disclaimer of warranties
Numero is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including accuracy, merchantability, fitness for a particular purpose and non-infringement. We do not promise that estimates are correct, that the service is uninterrupted, or that it is free of errors.
Limitation of liability
To the fullest extent permitted by law, Numero and Derek Gay will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, health outcome, or lost profits, arising out of or related to your use of Numero, even if advised of the possibility. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim, or fifty US dollars, whichever is greater. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnity
You agree to defend and hold harmless Numero and Derek Gay from claims arising out of your content or your breach of these terms.
Changes
We may update these terms. If a change is material we will update the date at the top of this page and tell you in the app. Using Numero after the change means you accept the new terms; if you do not, stop using the app and delete your account.
Governing law
These terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Texas, and you consent to their jurisdiction. If any part of these terms is found unenforceable, the rest remains in effect.
